General Terms & Conditions

By booking Wesley Stanfield Photography, you agree to the following terms and conditions. These policies are designed to protect both the Client and the Studio, and to ensure that your session is a positive and professional experience from start to finish.
Acknowledgement
When a client commissions Wesley Stanfield Photography, it is with the understanding that they have chosen to participate in a professional photography session. While the Studio cannot control how images may later be shared or distributed by the client, the client agrees to hold the Studio harmless from any claims or damages that might arise from such use. A Studio representative may be present at the session, and clients are welcome to bring one guest with prior approval.
Licensing and Image Use
Client is granted a non-exclusive, non-transferable license to use the purchased retouched images for the purposes described in this agreement. Usage is divided into tiers: a. Personal Use (Headshots, Portraits, Personal Branding): Portfolio, résumé, LinkedIn, social media, casting sites, personal promotion, personal website. No resale or commercial use allowed. b. Commercial / Business Use: Marketing, advertising, press, company websites, product promotions. Unlimited duration and geography unless otherwise stated. No resale, sub-licensing, or third-party distribution without written consent. c. Editorial / Beauty / Fashion Use: Use in magazines, blogs, and media outlets permitted with proper photographer credit. Client may submit images to publications only with Photographer’s approval.
Social Media and Editing
Only final, retouched, licensed images may be posted online. Proofs, screenshots, and unedited images are strictly prohibited. Clients may not apply filters, overlays, AI editing, or alterations that misrepresent the work. Cropping and resizing for layout is allowed, but significant changes must be performed only by the Photographer or an approved retoucher.
Ownership and Photographer’s Rights
Wesley Stanfield Photography retains full copyright and intellectual property rights to all images created. Licensing gives clients the right to use purchased images within agreed-upon terms, but does not transfer ownership. The Photographer may use images for portfolio work, website display, social media, competitions, or marketing unless the client requests privacy in writing. Private sessions can include a confidentiality addendum when necessary.
Compensation and Payment
All sessions are secured only upon receiving the booking fee. This fee is non-refundable and due at the time of receiving the invoice. It ensures that the client’s session is reserved. Rates may change in line with current pricing, promotions, or additional services. Balances must be paid in full before the delivery of final images. Payment plans are available through Afterpay, Klarna, or by special arrangement directly with the Studio.
Cancellations and Rescheduling
A booking or sitting fee is non-refundable. Clients are allowed one reschedule without penalty; additional reschedules require a new booking fee. If a client fails to perform under the agreement, the full balance becomes immediately due as liquidated damages, since the actual impact of a cancellation is difficult to measure.
Proofs and Image Selection
Proof galleries for headshot and branding sessions are typically available within two weeks of the session. For boudoir and editorial shoots, proofs are delivered within thirty days. Rush services are available for an additional fee. Clients are expected to select their final images within twenty days of receiving proofs. Proofs are for viewing and selection only and may not be screenshotted, downloaded, or posted online. Only purchased, retouched images are licensed for use.
Print Orders and Delivery
Orders for prints or add-ons must be paid for at the time of purchase. Orders must be placed within thirty days of receiving proofs, and those delayed beyond sixty days are subject to updated pricing. The Studio aims to complete all print and product orders within eight weeks, though timelines may be affected by third-party suppliers. Once completed, orders must be collected within twenty-one days of notification.
Liability and Waiver of Damages
The Studio takes all reasonable care with equipment, processing, and delivery of images. In the rare event of equipment failure, unforeseen circumstances, or even negligence, liability is limited to a refund of payments made. Missed shots or omitted requests do not void this agreement and will not result in compensation. Once published, the Photographer cannot be held responsible for third-party misuse of images. Clients agree to indemnify and hold harmless the Photographer from any claims arising from unauthorized use of images by the client or others.
Force Majeure
Neither the client nor the Photographer shall be liable for failure to perform due to circumstances beyond their control, such as natural disasters, severe weather, pandemics, government restrictions, strikes, or other unforeseen events. In such cases, session fees and retainers remain non-refundable but may be applied toward a rescheduled session at the Photographer’s discretion. If rescheduling is not possible within a reasonable timeframe, the Photographer will be released from further obligation without penalty.
Governing Law
This agreement is governed by the laws of the State of Georgia.
Credit
Credit in the form of “Photography by Wesley Stanfield Photography LLC” must accompany editorial, fashion, or commercial publications. Credit is encouraged, though not required, for personal use on social media, where clients are invited to tag @wesshots.
